TERMS & CONDITIONS – TRIONX GIVEAWAY LUCKY DRAW

1. Organiser

The Giveaway Lucky Draw (“Contest”) is organized by Triton International Pvt. Ltd., owner of the trionx brand (“Organiser”).

2. Nature & Purpose of the Contest

The Contest is a promotional activity intended to encourage engagement with trionx products.

Certain trionx notebooks include a Paint-by-Numbers activity, which forms an integral feature of the product.

Purchase of a trionx notebook is for the bona fide use of the product. Participation in the Contest is optional and incidental to such purchase.

The Contest is not intended to constitute gambling, betting, or a lottery and shall be conducted in compliance with applicable Indian laws and state regulations.

3. Free Method of Entry (No Purchase Necessary)

Participation in the Contest is also available without purchase.

To enter without purchase, participants may visit the official trionx website during the Contest Period and complete the online Paint-by-Numbers template provided, along with submission of required details.

Entries submitted through the free method shall have equal eligibility and winning chances as purchase-based entries.

4. Eligibility

• Open only to residents of India.
• Participants must be 18 years or older. Entries on behalf of minors must be submitted by a parent or legal guardian.
• Participants must submit a valid Paint-by-Numbers completion (physical or digital template).
• Employees of the Organiser, its affiliates, distributors, advertising agencies, and their immediate family members are not eligible.

5. Contest Period

The Contest shall be valid only during the period communicated on the official trionx website and/or official communication channels.

Entries received outside this period will not be considered.

6. How to Participate

To enter, participants must:

• Complete the Paint-by-Numbers activity (physical sheet or official digital template).
• Upload a clear photograph or digital image of the completed activity via the designated section of the trionx website.
• Submit accurate contact details including valid email and mobile number.
• Confirm acceptance of these Terms & Conditions.

Incomplete, illegible, manipulated, AI-generated, stock, or non-original submissions may be disqualified.

7. Entry Validation & Unique Entry Rule

Each valid mobile number shall constitute one entry.

Multiple submissions from the same mobile number will not increase winning chances.

The Organiser reserves the right to verify authenticity and reject fraudulent, duplicate, automated, or manipulated entries, or reject entries suspected of fraud or unfair advantage.

The Organiser’s determination regarding authenticity and eligibility shall be final.

The Organiser may require participants to provide additional photographs, process images, or verification materials to confirm authenticity.

Failure to provide satisfactory verification may result in disqualification.

8. No Separate Entry Fee

No separate fee is charged to participate.

Participation is voluntary and not mandatory upon purchase.

9. Winner Selection & Draw Process

Winners will be selected through a random computerized draw from all valid entries.

Completion of the Paint-by-Numbers activity is required for eligibility; however, artistic quality does not influence selection.

The draw will be conducted in a fair and transparent manner and may be supervised by an independent observer/auditor.

Odds of winning depend on the total number of eligible entries received.

The Organiser’s decision shall be final and binding.

Winners will be notified using the contact details provided.

If a selected winner does not respond within 7 days, an alternate winner may be selected.

The Organiser reserves the right to:

• Verify eligibility prior to declaring winners;
• Withhold prize distribution pending verification;
• Re-draw winners if eligibility conditions are not satisfied.

Prizes are non-transferable, non-exchangeable, and not redeemable for cash. The Organiser reserves the right to substitute prizes of equal or greater value.

Images used in promotional materials are for illustrative purposes only.

11. Prize Fulfilment & Delivery

Prizes will be dispatched within a reasonable period after verification.

Delivery is limited to addresses within India.

Any costs not expressly included shall be borne by the winner.

12. Prize Conditions & Original Artwork Requirement

Prize distribution is subject to verification of the winner’s identity, eligibility, and submission authenticity.

The Organiser reserves the right to require winners to submit the original physical Paint-by-Numbers artwork and/or additional verification materials prior to prize release.

Failure to provide the original artwork or requested verification within the specified time may result in disqualification and selection of an alternate winner.

The Organiser may retain submitted artwork for verification, audit, or promotional purposes.

13. Taxes & Statutory Compliance

Applicable taxes, including TDS under Section 194B of the Income Tax Act, shall be borne by the winner.

The Organiser may deduct applicable taxes before prize distribution.

14. Intellectual Property & Content Usage

By participating, the participant grants the Organiser a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, publish, display, adapt, modify, and distribute the submitted artwork for promotional, advertising, marketing, and commercial purposes across any media.

The participant waives any claim to compensation for such use.

The Organiser shall have the right to edit, adapt, or reproduce the artwork without further consent.

Participants confirm submissions are original and do not infringe third-party rights.

Publicity Consent

Winners agree that their name, city, photograph, and likeness may be used for promotional and publicity purposes without additional compensation, unless prohibited by law.

15. Disqualification

The Organiser reserves the absolute right, at its sole discretion, to disqualify any participant at any stage of the Contest if:

• The entry is false, misleading, fraudulent, manipulated, or inauthentic;
• The participant provides incomplete, inaccurate, or unverifiable information;
• The participant fails to provide requested verification materials, including the original artwork;
• Multiple, automated, bulk, or manipulated entries are detected;
• There is evidence of tampering, unfair influence, or misuse of the Contest process;
• The participant engages in conduct that is unlawful, abusive, deceptive, or prejudicial to the integrity or reputation of the Contest;
• These Terms & Conditions are violated.

The Organiser’s decision regarding disqualification shall be final and binding and shall not require further explanation or correspondence.

16. Limitation of Liability

Participation in the Contest is voluntary and at the sole risk of the participant.

To the fullest extent permitted by law, the Organiser, its directors, officers, employees, agents, distributors, affiliates, and partners shall not be liable for any:

• Technical malfunctions, system failures, server downtime, or network issues;
• Lost, late, incomplete, corrupted, or misdirected submissions;
• Unauthorized access, data breaches, or technical interference;
• Errors in administration, winner selection, or prize distribution;
• Interruption, delay, cancellation, or modification of the Contest;
• Loss, damage, injury, or harm arising from participation in the Contest;
• Loss, damage, injury, or harm arising from acceptance, use, misuse, or enjoyment of any prize.

To the maximum extent permitted by applicable law, the Organiser shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, loss of opportunity, reputational harm, or business interruption, arising out of or in connection with the Contest.

The Organiser’s total aggregate liability, if any, shall not exceed the retail value of the prize awarded to the participant.

Prizes provided under the Contest are supplied on an “as is” and “as available” basis.

The Organiser makes no representations or warranties, express or implied, regarding the quality, merchantability, fitness for a particular purpose, performance, or safety of any prize.

Any manufacturer’s warranty applicable to third-party products (including but not limited to Apple or Amazon devices) shall be the sole responsibility of the respective manufacturer, and winners must seek remedies directly from such manufacturer.

The Organiser shall not be responsible for defects, malfunctions, performance issues, or after-sales service relating to any prize.

The Organiser shall not be liable for any costs, injuries, damages, or losses resulting from the use or misuse of any prize.

By participating, participants agree to release, discharge, and hold harmless the Organiser and its affiliates from any claims, actions, damages, losses, or liabilities arising out of or relating to:

• Participation in the Contest;
• Acceptance or use of any prize;
• Submission of content;
• Violation of these Terms & Conditions.

Participants agree to indemnify and hold the Organiser harmless from claims arising from breach of these Terms, submission of infringing content, or misconduct.

18. Privacy & Data Protection

Personal data will be used for Contest administration, communication, and promotional purposes.

Participants consent to receiving contest-related communications and may opt out of marketing communications at any time.

Data will be retained only as long as necessary for contest administration and legal compliance.

Data will be handled in accordance with applicable Indian data protection laws.

19. Advertising & Platform Disclaimer

This Contest is not sponsored, endorsed, administered by, or associated with Apple, Amazon, Meta, Instagram, or any social media platform used for promotion.

20. Regulatory Compliance

The Contest shall be conducted in compliance with applicable laws, including consumer protection and state gaming laws.

Where required, the Organiser may obtain necessary permissions or conduct the draw under supervision to ensure transparency and fairness.

21. Force Majeure

The Organiser shall not be liable for failure or delay in performing obligations due to events beyond reasonable control, including natural disasters, regulatory actions, technical failures, or other unforeseen circumstances.

22. Modification, Suspension & Termination

The Organiser reserves the right to modify, suspend, extend, cancel, or terminate the Contest due to operational, regulatory, or unforeseen circumstances.

23. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts having jurisdiction at the Organiser’s registered office location shall have exclusive jurisdiction.
